Wendy C. Lascher, Esq. is a Certified Specialist in Appellate Law, California Board of Legal Specialization. She has handled more than 300 state and federal appeals and has argued in the United States Supreme Court, the U.S. Courts of Appeals for the 7th and 9th Circuits, the California Supreme Court, and the California Courts of Appeal. She is a board member of the American Academy of Appellate Lawyers, a past president of the California Academy of Appellate Lawyers, and a former chair of both the State Bar's Appellate Courts Committee and the Board of Legal Specialization's Appellate Law Advisory Committee.

Ms. Lascher graduated from Stanford University in 1970 and from the University of Michigan Law School in 1973. Among her landmark cases are In re Marriage of Pendleton and Fireman (2000) 24 Cal.4th 39, the first California case to hold spouses may waive spousal support in a properly drafted prenuptial agreement, Morehart v. County of Santa Barbara (1994) 7 Cal.4th 725; clarifying appealability of judgments on separately tried issues, and Sanchez v. Hillerich Bradsby (2002) 104 Cal.App.4th 703, holding that although the game of baseball includes an inherent risk a player may be hit by a batted ball, where a bat increases the risk above that inherent level, a player does not as a matter of law assume the risk of being hit by a batted ball. Ms. Lascher teaches appellate law at the Santa Barbara and Ventura Colleges of Law. She is a past president of the Ventura County Bar Association, and has been editor of its magazine, CITATIONS, for several years.

    Commencement of chapter 11: (a) ch.7 distinguished (and ch.9, 12, 13, 15), (b) voluntary/involuntary, (c) bankruptcy schedules and statement of financial affairs (SOFA), (d) employment and fee issues with respect to professionals, how are they paid, etc., (e) creditors’ committee, (f) governance during bankruptcy (debtor-in-possession as trustee, fishbowl, appointment of examiner or trustee, conversion, dismissal, etc), (g) trustee compliance / ongoing US Trustee compliance & reporting (monthly op reports, etc).

    Sales/settlements small sales that might occur during the course of a bankruptcy case w/out auctions (examples like Lahijani); sales of substantially all assets, 363 v. plan (“melting ice cube,” valuation/depreciation), sales free and clear (Clear Channel case, appeals, etc.)

    Plan formulation and confirmation: classification & voting, cramdown, competing plans/exclusivity, pre-packaged & pre-negotiated plans, etc.

    Tax issues: preservation of NOL (net operating loss), discharge of indebtedness income, etc.

    Special cases: single asset real estate, small business, etc.

    Local variances: Delaware v. 9th Circuit, LA v. SF, etc.

    Mette’s practice focuses on all aspects of financial restructuring, distressed situations, and bankruptcy issues, and she uses her experience to develop pragmatic and creative solutions to protect her client’s interests. Mette has represented a variety of creditors' committees, debtors, unsecured creditors, acquirers of bankrupt companies, and trustees both in out-of-court workouts and in federal bankruptcy cases.

    Nathan is an experienced financial advisor and management consultant who focuses on providing advisory services and interim management to distressed companies and their constituents, as well as companies in periods of transition. He has significant experience in crisis management, capital structure refinancing, cash and working capital management, cost reduction plan development and implementation, business plan development, valuation, and bankruptcy.

    Most recently, Nathan served as interim Chief Financial Officer of Hilex Poly Co. LLC (“Hilex”), which is the world’s largest plastic bag company. In this role, Nathan helped lead the company through a pre-packaged Chapter 11 restructuring and had day-to-day responsibility for managing the company’s accounting, finance, and IT functions. Prior to this role, Nathan served as Hilex’s interim Treasurer. As interim Treasurer, he directly managed the company’s liquidity and working capital activities, and assisted in the implementation of various initiatives, which led to an improvement in the company’s year-over-year EBITDA of almost 50%. During his tenure at Hilex, Nathan assisted in the negotiation and closing of $535 million of debt financing transactions.

    Prior to Hilex, Nathan served as an interim accounting Director for Mirant Corporation, a $3 billion competitive energy company. During the company’s Chapter 11 restructuring (the largest filed in the U.S. in 2003), Nathan led a team in the analysis of over $60 billion of inter-company transactions, as well as the resolution of various bankruptcy and litigation claims, which were critical gating items to the company’s emergence from bankruptcy.

    Nathan has advised debtors and creditors in various other restructuring matters, and frequently assists in complex bankruptcy litigation, including matters involving fraudulent conveyances, preferential transfers, and substantive consolidation. In addition, he has extensive valuation experience in restructuring, transactional, and litigation contexts.

    Prior to joining AlixPartners, Nathan was a Principal Consultant in the Financial Advisory Services group of Price Waterhouse. He was also previously a Senior Associate in the Business Strategy practice of Diamond Management and Technology Consultants, Inc., and a Senior Consultant of Peterson Consulting (now a division of Navigant Consulting). Further, Nathan previously worked at Hewlett Packard (“HP”), where he assisted in the IPO and financial separation of Agilent Technologies from HP.

    Nathan holds an MBA in finance and corporate strategy from the UCLA Anderson School of Management, where he served as President of the Management Consulting Association. He holds a BBA in accounting from the University of Michigan Ross School of Business, where he graduated with high distinction. Nathan is a CPA and a Level III CFA Candidate, and is a Board member of the Turnaround Management Association – Southern California Chapter.     Neil Bason practices in the area of business reorganization and financial restructuring. Mr. Bason's practice encompasses representation of trustees, secured and unsecured creditors, entities contemplating or initiating bankruptcy cases or workouts, persons who seek to purchase assets out of bankruptcy and third parties whose interests need to be protected in distressed debt situations, including parties to contracts and leases with debtors in bankruptcy.

    Prior to joining Duane Morris, Mr. Bason served for eight years as a law clerk to U.S. Bankruptcy Judge Dennis Montali in the Northern District of California and Bankruptcy Appellate Panel of the Ninth Circuit.

    During his tenure, he worked on approximately 70 BAP decisions and numerous trial court dispositions. Before clerking Mr. Bason was in private practice for a decade in Massachusetts and in the Bay Area, during which time he focused primarily on debtor-creditor disputes.

    Following law school, Mr. Bason was a law clerk to Chief Justice Paul J. Liacos of the Supreme Judicial Court of Massachusetts.

    Educated in Illinois, Co-Chair/Commentator Brian Myers holds degrees in business and in law, and also has substantial coursework in math, science and engineering. County of Santa Barbara (1994) 7 Cal.4th 725; clarifying appealability of judgments on separately tried issues, and Sanchez v. Hillerich Bradsby (2002) 104 Cal.App.4th 703, holding that although the game of baseball includes an inherent risk a player may be hit by a batted ball, where a bat increases the risk above that inherent level, a player does not as a matter of law assume the risk of being hit by a batted ball. Ms. Lascher teaches appellate law at the Santa Barbara and Ventura Colleges of Law. She is a past president of the Ventura County Bar Association, and has been editor of its magazine, CITATIONS, for several years.

    Nathan is an experienced financial advisor and management consultant who focuses on providing advisory services and interim management to distressed companies and their constituents, as well as companies in periods of transition. He has significant experience in crisis management, capital structure refinancing, cash and working capital management, cost reduction plan development and implementation, business plan development, valuation, and bankruptcy.

    Most recently, Nathan served as interim Chief Financial Officer of Hilex Poly Co. LLC (“Hilex”), which is the world’s largest plastic bag company. In this role, Nathan helped lead the company through a pre-packaged Chapter 11 restructuring and had day-to-day responsibility for managing the company’s accounting, finance, and IT functions. Prior to this role, Nathan served as Hilex’s interim Treasurer. As interim Treasurer, he directly managed the company’s liquidity and working capital activities, and assisted in the implementation of various initiatives, which led to an improvement in the company’s year-over-year EBITDA of almost 50%. During his tenure at Hilex, Nathan assisted in the negotiation and closing of $535 million of debt financing transactions.

    Prior to Hilex, Nathan served as an interim accounting Director for Mirant Corporation, a $3 billion competitive energy company. During the company’s Chapter 11 restructuring (the largest filed in the U.S. in 2003), Nathan led a team in the analysis of over $60 billion of inter-company transactions, as well as the resolution of various bankruptcy and litigation claims, which were critical gating items to the company’s emergence from bankruptcy.

    Nathan has advised debtors and creditors in various other restructuring matters, and frequently assists in complex bankruptcy litigation, including matters involving fraudulent conveyances, preferential transfers, and substantive consolidation. In addition, he has extensive valuation experience in restructuring, transactional, and litigation contexts.

    Prior to joining AlixPartners, Nathan was a Principal Consultant in the Financial Advisory Services group of Price Waterhouse. He was also previously a Senior Associate in the Business Strategy practice of Diamond Management and Technology Consultants, Inc., and a Senior Consultant of Peterson Consulting (now a division of Navigant Consulting). Further, Nathan previously worked at Hewlett Packard (“HP”), where he assisted in the IPO and financial separation of Agilent Technologies from HP.

    Nathan holds an MBA in finance and corporate strategy from the UCLA Anderson School of Management, where he served as President of the Management Consulting Association. He holds a BBA in accounting from the University of Michigan Ross School of Business, where he graduated with high distinction.     Neil Bason practices in the area of business reorganization and financial restructuring.     Brian Myers

    Educated in Illinois, Co-Chair/Commentator Brian Myers holds degrees in business and in law, and also has substantial coursework in math, science and engineering. He has advised scores of companies on IP licensing. He now focuses on advising emerging companies and entrepreneurs, and on educating general practice attorneys. He is very active within the MIT Enterprise Forum, having served as its President and as its director of 50 seminars for executives, entrepreneurs and attorneys about key IP commercialization strategies for every stage of a company’s development.

    Brian started his career at KPMG, where he helped structure major international transactions. Among her landmark cases are In re Marriage of Pendleton and Fireman (2000) 24 Cal.4th 39, the first California case to hold spouses may waive spousal support in a properly drafted prenuptial agreement, Morehart v. County of Santa Barbara (1994) 7 Cal.4th 725; clarifying appealability of judgments on separately tried issues, and Sanchez v. Hillerich Bradsby (2002) 104 Cal.App.4th 703, holding that although the game of baseball includes an inherent risk a player may be hit by a batted ball, where a bat increases the risk above that inherent level, a player does not as a matter of law assume the risk of being hit by a batted ball. Ms. Lascher teaches appellate law at the Santa Barbara and Ventura Colleges of Law. She is a past president of the Ventura County Bar Association, and has been editor of its magazine, CITATIONS, for several years.

    Educated in Illinois, Co-Chair/Commentator Brian Myers holds degrees in business and in law, and also has substantial coursework in math, science and engineering. He has advised scores of companies on IP licensing. He now focuses on advising emerging companies and entrepreneurs, and on educating general practice attorneys. As Supervisor of the Appellate Section of the Criminal Branch of the Los Angeles City Attorney's Office, and in the Appellate Section of the Civil Branch, Mr. Wolff has briefed and argued over 350 appeals and 100 writ proceedings. He has been an Adjunct Professor at UC Hastings College of the Law since 2000, where he teaches Moot Court and Legal Writing & Research. Hillerich Bradsby (2002) 104 Cal.App.4th 703, holding that although the game of baseball includes an inherent risk a player may be hit by a batted ball, where a bat increases the risk above that inherent level, a player does not as a matter of law assume the risk of being hit by a batted ball. Ms. Lascher teaches appellate law at the Santa Barbara and Ventura Colleges of Law. She is a past president of the Ventura County Bar Association, and has been editor of its magazine, CITATIONS, for several years.

    Bankruptcy practice is a very specialized field.  Chapters 7 and 13 involve complicated procedures, law, issues and players.  This seminar will provide you with an introduction to handling Chapters 7 and 13 bankruptcy cases.  Expert practitioners as well as Trustees and a career bankruptcy court law clerk will guide you through the process.

    Bankruptcy Court related topics include: an introduction to the Bankruptcy court, electronic filing issues, motion practice, adversary proceedings, appeals and ethics.

    Chapter 7 basics will also include creditor's representation, debtor's representation, and the role of the Trustee.  For those representing the debtor, you will learn about the attorney's tool kit, the pre-petition information gathering process, income, expense and means test, credit counseling certificates, filing and its effect, 4002 documents, the 341 meeting, deadlines for discharging the complaint, the financial education requirement, discharge, interaction with the Chapter 7 Trustee and the U.S. Trustee, various types of claim treatment.  You will also learn about what happens to the assets.  For those representing the creditor, you will learn about creditor's rights, special situations, treatment of secured claims in reorganization cases, judgment lien avoidance, exceptions and objections to discharge, and dismissal and conversion.

    Nathan is an experienced financial advisor and management consultant who focuses on providing advisory services and interim management to distressed companies and their constituents, as well as companies in periods of transition. He has significant experience in crisis management, capital structure refinancing, cash and working capital management, cost reduction plan development and implementation, business plan development, valuation, and bankruptcy.

    Most recently, Nathan served as interim Chief Financial Officer of Hilex Poly Co. LLC (“Hilex”), which is the world’s largest plastic bag company. In this role, Nathan helped lead the company through a pre-packaged Chapter 11 restructuring and had day-to-day responsibility for managing the company’s accounting, finance, and IT functions. Prior to this role, Nathan served as Hilex’s interim Treasurer. As interim Treasurer, he directly managed the company’s liquidity and working capital activities, and assisted in the implementation of various initiatives, which led to an improvement in the company’s year-over-year EBITDA of almost 50%. During his tenure at Hilex, Nathan assisted in the negotiation and closing of $535 million of debt financing transactions.

    Prior to Hilex, Nathan served as an interim accounting Director for Mirant Corporation, a $3 billion competitive energy company. During the company’s Chapter 11 restructuring (the largest filed in the U.S. in 2003), Nathan led a team in the analysis of over $60 billion of inter-company transactions, as well as the resolution of various bankruptcy and litigation claims, which were critical gating items to the company’s emergence from bankruptcy.

    Nathan has advised debtors and creditors in various other restructuring matters, and frequently assists in complex bankruptcy litigation, including matters involving fraudulent conveyances, preferential transfers, and substantive consolidation. In addition, he has extensive valuation experience in restructuring, transactional, and litigation contexts.

    Prior to joining AlixPartners, Nathan was a Principal Consultant in the Financial Advisory Services group of Price Waterhouse. He was also previously a Senior Associate in the Business Strategy practice of Diamond Management and Technology Consultants, Inc., and a Senior Consultant of Peterson Consulting (now a division of Navigant Consulting). Further, Nathan previously worked at Hewlett Packard (“HP”), where he assisted in the IPO and financial separation of Agilent Technologies from HP.

    Nathan holds an MBA in finance and corporate strategy from the UCLA Anderson School of Management, where he served as President of the Management Consulting Association. Her legal education included study in Vienna, Austria, Budapest, Hungary, and interning at a Barrister firm in London, England. Ms. Mazzarella is admitted to practice law in California, the United States District Court in the Southern District of California, the United States Court of Appeals for the Ninth Circuit, and the United States Supreme Court.

    United States Immigration Judge (Retired)

    The Honorable Bruce J. Einhorn served as a United States Immigration Judge in Los Angeles from July 29, 1990 through January 31, 2007. In that capacity, he presided over prosecutions initiated by the U.S. Department of Homeland Security (“DHS”) against non-citizens in the United States whose lawful presence here has been placed into question by counsel for the government, including alleged terrorists. Judge Einhorn presided over bench trials in which DHS seeks the removal or deportation of non-citizens based on the circumstances of their entry into the country and/or their conduct (including their alleged terrorist and criminal conduct) following their arrival in the United States. Judge Einhorn also adjudicated the claims for relief of those non-citizens, including their applications for asylum and relief under the United Nations Convention against Torture. As a young lawyer with the U.S. Department of Justice in 1980, Judge Einhorn helped draft the final version of the Refugee Relief Act which, for the first time in U.S. history, gave non-citizens the right to apply for asylum in the United States. Judge Einhorn thus adjudicated claims under the very statute of which he was a principal draftsperson. He has served as the Presiding Immigration Judge for Los Angeles and has also served as an instructor at the training academy for newly appointed immigration judges. In November 2007, Judge Einhorn hosted a National Conference on Asylum at Pepperdine University.

    On matters of immigration law, Bruce Einhorn has argued cases before the United States Courts of Appeals for the Ninth, Sixth, and other Circuits, and before the U.S. Supreme Court. He has given numerous lectures on federal appellate and trial advocacy.

    Bruce Einhorn has lectured on issues of international humanitarian law before the International Association of Refugee Law Judges, and has served with its Committee on Vulnerable Peoples. He has also conducted continuing legal education seminars for the American Immigration Law Association and the Los Angeles County Bar Association. Finally, he has conducted seminars on the interplay of federal immigration law and California criminal law before the Los Angeles County Superior Court Judges’ Conference, the State Public Defenders’ Conference, and several law school classes of several universities. He has also appeared on ABC television and CNN to discuss and advocate immigration reform, and National Public Radio to discuss national security and civil liberties in the post-9/11 world. Einhorn has also spoken to the Muslim Students Association of UCLA Law School on the dangers of ethnic and religious profiling post-9/11. Judge Einhorn was the judge who dismissed deportation proceedings against the last of the “L.A. Eight,” Palestinians accused of engaging in terrorist activities. Einhorn found the government’s failure to disclose potentially exculpatory evidence against the respondents to constitute a denial of the latter’s due process and statutory rights. The Department of Homeland Security decided to drop its appeal of Judge Einhorn’s dismissal of the cases.

    As an immigration judge, Bruce Einhorn issued major decisions on the granting of asylum to the following persecuted peoples: religious minorities, including Muslims from Europe, Evangelical Christians from the Middle East, China, and Russia, and Jews and Bah’ai members from Iran; women facing “honor killings,” victims of female genital mutilation and of rape in Africa, South Asia, and parts of the Arab world; racial and ethnic minorities from Nigeria, the Sudan, and Indonesia; and political dissidents, gays, and lesbians from many countries. Bruce Einhorn was also the first immigration judge to grant asylum to HIV-positive individuals and disabled children who faced socially-based persecution and the denial of available medical treatment in their native countries. Einhorn is currently working on his professional autobiography, and on a book about the legal and political culture of citizenship in the West, and particularly the United States.

    Since 1991, Judge Einhorn has also served as an Adjunct Professor of Immigration Law, International Human Rights Law and War Crimes Studies, and Legal Ethics at Pepperdine University School of Law in Malibu, California. He also sits on the Law School’s Board of Visitors. In 1997, Judge Einhorn received the Law School’s David McKibbin Excellence in Teaching Award.

    In 1999, Bruce Einhorn was honored for his ADL activities with the Daniel Ginsberg National Leadership Award in Civil Rights, presented to him in the presence of President Bill Clinton at a ceremony at the Ebenezer Baptist Church in Atlanta, Georgia, the home church of the late Dr. Martin Luther King, Jr. He has also been honored for his ADL activities by Representatives Howard Berman and Xavier Becerra of the U.S. House of Representatives, the California State Legislature, the Los Angeles County Board of Supervisors, and the Los Angeles City Council. As a Jewish communal leader, Einhorn has also received a Lifetime Professional Achievement Award from the State of Israel.

    Bruce J. Einhorn received his B.A. degree in history in 1975, magna cum laude, from Columbia College of Columbia University, and his J.D. degree in 1978 from New York University Law School. He is a member of Phi Beta Kappa, the national honors fraternity. In 1986, Judge Einhorn received NYU Law School’s Recent Graduate Award. From September 1978 to September 1979, Einhorn served as a judicial law clerk with the District of Columbia Court of Appeals. In 1979, he was accepted into the U.S. Justice Department’s Honors Program for Distinguished Law Graduates and Clerks. He is a member of the Bar of the United States Supreme Court, the American Bar Association, the American Academy of Political Science, the American Civil Liberties Union, the U.S. Supreme Court Historical Society, the Organization of American Historians, the Abraham Lincoln Association, and the Theodore Roosevelt Association.

    Bruce Einhorn has also participated as a presenter in continuing legal education seminars for health care professionals and attorneys in matters of medical malpractice law. He is occasionally engaged in arbitration and mediation work with Alternative Resolution Centers in Century City, California. Einhorn has also been involved in Bar conferences on the economic impact of immigration and on copyright and intellectual property law.

    Robert B. Jobe is widely recognized as one of the nation’s finest immigration litigators. He has litigated at all levels of the federal court system (including the United States Supreme Court), testified in the United States House of Representatives, authored numerous articles and a leading treatise on the law of asylum, and lectured widely on immigration-related issues. In recognition of his achievements, Mr. Jobe has been awarded the American Immigration Lawyers Association’s Jack Wasserman Award for Excellence in Immigration Litigation (Houston, Texas 1998), the Immigrant Legal Resource Center’s Phillip Burton Award for Outstanding Immigration Lawyering (San Francisco, California 1993), and the National Coalition to Protect Political Freedom's Constitutional Rights Award For Outstanding Legal Service Against the Use of Secret Evidence (Washington, D.C. 2001). In 2005, 2006 and 2007, he was named one of Northern California’s “Super Lawyers” by San Francisco magazine.

    Mr. Jobe has served as counsel in several of the most significant immigration cases of the last decade: Asylum: Through his litigation efforts, Mr. Jobe has defined the contours of asylum law in the western United States on issues ranging from the definition of persecution and whether the threat of persecution must exist country-wide to whether an alien who has engaged in "terrorist activities" can be barred from asylum as a danger to national security. Ilchert, 69 F.3d 375 (9th Cir. 1995); Jagraj Singh v. Ilchert, 801 F. Supp. 313 (N.D.Cal. 1992); Matter of N-M-A-, Int. Dec. 3368 (BIA 1998).

    Criminal Aliens: Mr. Jobe has litigated a wide variety of cases relating to criminal aliens, including Murillo-Salmeron v. INS, 327 F.3d 898 (9th Cir. 2003) (simple drunk driving is not a crime involving moral turpitude); Kankamalage v. INS, 335 F.3d 858 (9th Cir. 2003) (the particularly serious crimes bar to asylum does not apply to guilty pleas obtained before the bar's enactment); Park v. INS, 252 F.3d 1018 (9th Cir. 2001) (to be a crime of violence, an offence must have a mens rea of at least recklessness); Lujan-Armendariz v. INS, 222 F.3d 728 (9th Cir. 2000) (convictions for simple possession of a controlled substance which have been expunged pursuant to a state rehabilitative statute can not be a basis for deportation); Aguilera-Medina v. INS, 137 F.3d 1401 (9th Cir. 1998), (lawful temporary resident aliens who have been convicted of alien smuggling within five years of a "brief, casual, and innocent departure" are not deportable).

    Suspension of Deportation: Mr. Jobe was at the forefront of efforts to blunt the impact of legislation (enacted in 1996) which restricts the availability of suspension of deportation (a defense to deportation which had been available to aliens who have lived in this country for more than seven years). In Barahona-Gomez v. Reno, 167 F.3d 1228 (9th Cir. 1999), aff'd 236 F.3d 1115 (9th Cir. 2001), Mr. Jobe challenged the government’s refusal to adjudicate applications for suspension of deportation until the legislative restrictions took effect. Through that litigation, Mr. Jobe and his co-counsel obtained an injunction against the deportation of hundreds of class members.

    In Guadalupe-Cruz v. INS, 250 F.3d 1271 (9th Cir. 2001), Castillo-Perez v. INS, 212 F.3d 518 (9th Cir. 2000), and Matter of N-J-B-, 21 I & N Dec. 812 (BIA 1997), Mr. Jobe challenged the government’s application of the new "stop time" rule, which requires a suspension of deportation applicant to demonstrate that he or she had accumulated seven years physical presence in the United States before the commencement of deportation proceedings. In Guadalupe-Cruz, the court precluded INS from applying the stop time rule to applicants who had hearings before April 1997. In Castillo-Perez, the Court ruled that the stop time rule can not be applied to aliens who would have had a hearing on their application for suspension of deportation before April 1997 but for the ineffective assistance of a former attorney.

    Visa Processing: In 1995, Mr. Jobe and his best friend from law school, Daniel Wolf, spearheaded a pro bono legal challenge to the Department of State's policy of refusing to issue immigrant visas to Vietnamese boat people detained in Hong Kong. See,Legal Assistance for Vietnamese Asylum Seekers v. Dep’t.of State, 45 F.3d 469 (D.C. Cir. 1995)("LAVAS I"); Legal Assistance for Vietnamese Asylum Seekers v. Dep’t. of State (LAVAS II), 74 F.3d 1308 (D.C. Cir. 1996); and Vo Van Chau v. Dep’t. of State, 891 F. Supp. 650 (D.D.C. 1996). In LAVAS I, the D.C. Circuit declared the State Department’s policy unlawful. The State Department appealed to the U.S. Supreme Court, which agreed to hear the case. Shortly before oral argument in the United States Supreme Court, Congress amended the Immigration and Nationality Act to specifically override the D.C. Circuit's decision in LAVAS I. The Supreme Court then vacated LAVAS I and remanded for reconsideration of the legislative changes. As a result of the litigation, however, over 100 Vietnamese nationals living in refugee camps in Hong Kong were able to immigrate to the United States.

    Ineffective Assistance of Counsel: Maravilla-Maravilla v. Ashcroft, 381 F.3d 855 (9th Cir. 2004) (to establish prejudice, aliens alleging ineffective assistance of counsel must show only plausible grounds of relief); Matter of N-K- and V-S-, I & N Dec. 879 (BIA 1997), (an attorney's failure to notify an alien of the date, time, and place of her exclusion hearing constitutes ineffective assistance of counsel and requires reopening of an exclusion proceeding conducted in absentia). On May 8, 1996, Mr. Jobe testified before the United States House of Representatives Subcommittee on International Operations and Human Rights about the need to enact legislation to implement the United Nations Convention Against Torture.Before going into private immigration practice, Mr. Jobe investigated violations of the laws of war in El Salvador on behalf of Americas Watch (now Human Rights Watch) and contributed to a lengthy report on human rights violations in El Salvador, The Civilian Toll (New York: Americas Watch 1987). He also served as the Supervising Attorney at La Raza Centro Legal (July 1988-January 1990), was an associate attorney at McCutchen, Doyle, Brown & Enersen (August 1987 - July 1988), and a legislative aide in the Michigan House of Representatives (1982-83).

    Brian Myers

    Educated in Illinois, Co-Chair/Commentator Brian Myers holds degrees in business and in law, and also has substantial coursework in math, science and engineering. He has advised scores of companies on IP licensing. He now focuses on advising emerging companies and entrepreneurs, and on educating general practice attorneys. He is very active within the MIT Enterprise Forum, having served as its President and as its director of 50 seminars for executives, entrepreneurs and attorneys about key IP commercialization strategies for every stage of a company’s development.

    Brian started his career at KPMG, where he helped structure major international transactions. He eventually joined Gray Cary (now in DLA Piper), where he helped on (among many other deals) the big California merger of Active Voice into Cisco Systems. Other representative transactions include lead responsibility for metals, digital/data and transportation clients. Brian has spent 20+ years advising startup entrepreneurs, small/medium companies, and publicly traded corporations.

    Brian also teaches law and MBA students. He now practices alone, allowing him a bigger role in helping manage his clients’ businesses. Brian also runs a private equity firm, Medici Northwest.

Entertainment Television, The International Channel, Channel One News - a national news network broadcast to high schools.  Ms. Chee also helped launch Entertainment Tonight China for Paramount Pictures.

    Her career has taken her across the country and her work has been seen around the world. With more than a decade of experience in the broadcast industry, Ms. Chee has interviewed prominent politicians, business executives, and officials as well as the leading actors in Hollywood. Prior to launching her broadcasting career, Ms. Chee worked in advertising and public relations. With her extensive media experience on both sides of the communications fence Ms. Chee knows how to get the story and communicate effectively.

    Many of her stories included high profile court cases from the Robert Blake Murder Trial to the Michael Jackson Molestation Trial to the Danielle Van Dam murder and David Westerfield Trial.  In 2002, Ms. Chee also got an exclusive jailhouse interview with Tanya Hadden, the California school teacher convicted of having sex with her 15 year old student.

    She received a B.A. in Communication from the University of California, Santa Barbara.  After college she lived in China and studied at Nanjing University.  She is a member of the Asian American Journalists Association. She also serves as a motivational speaker for businesses and community organizations.

    Course Summary

    Join us for a hands on intermediate to advanced SLAPPinar on the elusive "gravamen" concept that has permeated California anti-SLAPP jurisprudence since the 2002 High Court decision in City of Cotati v. Cashman (2002) 29 Cal.4th 69.

    Subsequent cases have mangled and misapplied the “gravamen” concept by applying it to the first prong analysis of mixed causes of action, adding to the confusion surrounding an already difficult cause of action.

    The significant disagreement among the various Appellate Districts, as to the proper formulation and application of the "gravamen" rule, will be pointed out and discussed.

    To make matters more complex, there is an often missed reverse "gravamen" rule that applies on the second prong analysis designed to help plaintiffs survive SLAPP motions on the probability of prevailing - merits prong.

    The speaker will analyze actual complaints when explaining the "gravamen" issue.

    Finally, there will be a brief discussion of the recent exception to the no amendment rule and how expert declarations in SLAPP fee motions can dramatically affect the result.
